Summary: In the summer of 2024, the Supreme Court issued three watershed decisions in administrative law: Loper Bright, Corner Post, and Jarkesy. This panel explores the impact of those decisions on federal agencies, the courts, and private parties over the past 18 months. Did these decisions have the paradigm-shifting effect that some commentators predicted? How have the Federal Circuit and its sister courts dealt with lingering questions such as stare decisis and Skidmore deference? How have the agencies themselves responded? The panel will also discuss the Federal Circuit’s en banc hearing in Lesko v. US as a case study of how these issues are playing out.
