Protests Before the Federal Circuit: Key Case Law Developments and Their Impact

Overview: In the last two years, the U.S. Court of Appeals for the Federal Circuit has issued more than a dozen decisions involving bid protest decisions appealed from the U.S. Court of Federal Claims, a substantial increase from prior years. The Federal Circuit has examined procedural and jurisdictional requirements specific to bid protests and clarified substantive rules in areas such as agency evaluations of proposals and prejudice. This year’s Government Contracting Summit will convene judges, attorneys and practitioners to offer perspectives on the Federal Circuit’s bid protest docket and its impact on bid protest jurisprudence.
