Summary:
The panel will discuss the Court’s blockbuster decision at the close of this term determining the future of Chevron deference in Loper Bright Enterprises v. Raimondo and Relentless, Inc. v. Department of Commerce. Chevron deference arises in the context of federal agency interpretations of the federal statutes that those agencies administer. For years there have been strong feelings against the doctrine, including separation of powers concerns. The panel will discuss the history of the doctrine and how we arrived at the cases this term. The panel will discuss the Court’s treatment of the doctrine and what that means for the future of agency affairs, courts, and government and private litigants.
