Panel Summary
Damages continue to be one of the most significant issues affecting the risk profile and outcome of patent cases, and the legal landscape continues to change. This panel will discuss the latest developments in the law of damages, and also offer practical advice from practitioners and in-house counsel on choosing damages experts, working with damages experts on their reports, and complying with rules on disclosing damages contentions. The panel also will explore the latest trends in Rule 702 motions that challenge damages methodologies, including the proposed amendments to Rule 702 and their potential impact on challenges to damages methodologies. Finally, the panel will compare the damages models and theories in patent and trade secrets cases, and consider theories that have recently emerged to support large jury verdicts in both patent and trade secret cases.
