The MSPB Appeals Committee Presents:
Settlements Before the MSPB and the Return of Clean Record Agreements

Cathy Harris, Acting Chairman, U.S. Merit Systems Protection Board
Joel Alexander, Administrative Judge, U.S. Merit Systems Protection Board
Brian Bohlen, Administrative Judge, U.S. Merit Systems Protection Board

The MSPB has a new initiative to facilitate settlement in some of the numerous cases pending on petition for review (PFR) as a result of the long period without a quorum. The new program, called the PFR Rapid Assessment Mediation Program, focuses on cases in which a change in the law or circumstances suggests a path to a mediated resolution. This new initiative is in addition to the Board’s well-established Mediation Appeals Program. Settlement of Federal employment disputes before the Board has been made easier by the rescission of the Executive Order limiting clean-record settlements. This program will discuss the Board’s settlement efforts and the use of clean-record settlements before the MSPB. Judge Alexander and Judge Bohlen coordinate the Board’s two settlement programs.
