Settlements Before the MSPB and the Return of Clean Record Agreements

Summary:
The MSPB has a new initiative to facilitate settlement in some of the numerous cases pending on petition for review (PFR) as a result of the long period without a quorum. The new program, called the PFR Rapid Assessment Mediation Program, focuses on cases in which a change in the law or circumstances suggests a path to a mediated resolution. This new initiative is in addition to the Board’s well-established Mediation Appeals Program. Settlement of Federal employment disputes before the Board has been made easier by the rescission of the Executive Order limiting clean-record settlements. This program will discuss the Board’s settlement efforts and the use of clean-record settlements before the MSPB. Judge Alexander and Judge Bohlen coordinate the Board’s two settlement programs.
