Summary: In 2020, the Federal Circuit issued a pair of decisions that illuminated the similarities – and differences – between fee-shifting under the Equal Access to Justice Act, available broadly in litigation against the United States, and fee-shifting available in patent and copyright cases under 28 U.S.C. § 1498(a). The panel will explore each and illuminate the distinctions.
