Summary
The Federal Circuit’s landmark decision in Acetris Health, LLC v. United States, 949 F.3d 719 (Fed. Cir. 2020) upended a longstanding test government agencies use to determine whether a product qualifies as a “U.S.-made end product” under the Federal Acquisition Regulation’s implementation of the Trade Agreements Act (TAA) and the Buy American Act (BAA). Acetris has also sparked attempts to overturn aspects of the decision in the seven months since the ruling.
